O segundo dia de debates do Seminário Eleições 2018: Perspectivas para o Saneamento no Brasil foi aberto com a discussão sobre a MP 844/2018. Na ocasião, representantes das principais entidades do setor de saneamento apresentaram suas opiniões sobre os efeitos do normativo na gestão dos serviços de abastecimento de água e de colete e de tratamento de esgotos.
O primeiro a falar foi o presidente da Associação Brasileira de Engenharia Sanitária e Ambiental – ABES, Roberval Tavares (que esteve presente também na mesa de abertura realizada nesta segunda). Ele destacou a necessidade de derrubada da MP 844/2018 e a comparou a uma tomada de três pinos. “A MP é uma tomada de três pinos. Só tem no Brasil e não serve pra nada.”, afirmou. Para Roberval a iniciativa do governo federal de modernizar o marco regulatório do setor já deveria estar surtindo efeito, pois ao se adotar o formato de Medida Provisória, que demanda os princípios de relevância e de urgência, resultados já deveriam ser percebidos pelo setor.
Outro destaque na fala de Roberval diz respeito ao artigo 10-A, que trata do chamamento público. Para Roberval a lógica de estimular a concorrência para estimular a eficiência, contida no referido dispositivo, rompe o mecanismo de economia de escala e do subsídio cruzado e prejudica a gestão regional dos serviços. “Isso pode até melhorar a gestão dos serviços de saneamento em alguns municípios, mas vai piorar a situação na maioria”.
Para demonstrar a desestruturação do modelo de gestão regional, Roberval antecipou as conclusões de um estudo sobre o caso do Estado de Amazonas que teve o município de Manaus retirado da concessionária estadual resultando numa significativa piora da prestação dos serviços de saneamento. Roberval afirmou também que o estudo será divulgado brevemente com as devidas considerações referentes ao levantamento.
Por fim, Roberval ressaltou a necessidade de se melhorar o marco regulatório existente, mas pontuou que subverter a ordem existente prejudicará todo o setor.
Em seguida, a palavra foi concedida ao presidente da Associação Nacional dos Serviços Municipais de Saneamento (Assemae), Aparecido Hojajij, que também reiterou a necessidade de derrubada da MP 844/2018. Para Aparecido, o texto da MP é capcioso. “O que parece ser bom lá na frente se mostra uma pegadinha”, afirmou Hojajij.
O presidente da Assemae pontuou os principais aspectos, que na opinião da entidade, são os mais controversos. Começou falando das novas atribuições da ANA, que segundo o presidente não possui competência técnica ao cumprimento do exigido. Outra questão abordada foi a substituição dos planos de saneamento por estudos de viabilidade. Para Hojaij, isso descontrói a cultura de planejamento inserida no setor pela Lei 11.445/2018. Entre outras questões.
Na sequência a palavra foi concedida ao representante da Frente Nacional pelo Saneamento Ambiental (FNSA), Abelardo Oliveira, que também teceu uma série de críticas à MP e frisou que existe uma “falácia” sobre a participação privada no setor. “Muitos acreditam que a operação privada é melhor que a pública, mas existem dados que comprovam que em algumas situações o que foi prometido não foi entregue”, completou.
Contraponto – O contraponto nas falas do painel foi a apresentação do Diretor Institucional da Associação Brasileira das Concessionárias Privadas de Serviços Públicos de Água e Esgoto (ABCON), Percy Soares Neto, que iniciou sua fala reconhecendo um ponto incomum entre as entidades: o reconhecimento da necessidade de se estabelecer mais parcerias com setor privado e ponderou: “precisamos descobrir os caminhos para estabelecer essas parcerias, não só no ramo dos negócios mas também no da regulação.”, afirmou.
Percy, afirmou que a MP pode ser um caminho viável à melhoria da gestão do setor e que para isso basta melhorar alguns pontos. Outro destaque em sua fala foi a retomada dos investimentos. Percy apresentou dados estarrecedores. Atualmente o nível dos investimentos no setor está nos patamares de 0,2% ou 0,3% do PIB.
O representante lembrou que, conforme estudo elaborado pelo CNI, cada R$ 1,00 no saneamento o retorno para o setor produtivo é de R$ 2,50 e que esse retorno seria ainda superior se considerada a economia nos dispêndios com saúde, a valorização de imóveis e o aumento na produtividade dos trabalhadores.
O painel foi coordenado por Jorge Melo, presidente da Corsan, e mediado por Neurisângelo de Freitas, presidente da Cagece. Participaram também do painel Roberval Tavares, presidente da Abes, Aparecido Hojaij, presidente da Assemae, José Walter Vazquez Filho, presidente da Abar, Percy Soares Neto, presidente da Abcon, e Abelardo de Oliveira, representante da Frente Nacional pelo Saneameno Ambiental (FNSA).
O seminário prossegue, na tarde de hoje, com um painel técnico que trará as experiências das Companhias Estaduais de Saneamento na gestão e na operação dos serviços. O evento está acontecendo em Brasília (DF), no Hotel Royal Tulip.
