Foi realizado, no dia 5 de outubro, durante o 28º Congresso Brasileiro de Engenharia Sanitária e Ambiental, no Riocentro, Rio de Janeiro, o primeiro workshop de cooperação técnica para regulação do setor de água e saneamento no Brasil, fruto do convênio entre o Banco Interamericano de Desenvolvimento – BID e a ABES. Direcionado aos profissionais do setor ligados à regulação do saneamento, a iniciativa teve caráter preparatório para curso EAD (ensino a distância) de capacitação profissional que o projeto oferecerá.
Na ocasião, além do projeto, foi apresentado ainda um diagnóstico preliminar retratando o panorama da regulação no Brasil. O evento contou com a participação de representantes dos setores público e privado e da sociedade civil, entre os quais estão o vice-presidente nacional da ABES, Álvaro Menezes, Henry Moreno, do Banco Interamericano de Desenvolvimento – BID, e Paulo Ferreira, Secretário Nacional de Saneamento Ambiental.
O evento contou, ainda, com a participação da Siglasul, consultoria contratada para desenvolver e implementar o projeto juntamente com a ABES. Estiveram presentes os seus diretores Luis Fernando Alvarez, Sebastian Butto e Leonardo Campos.
Para Álvaro Menezes, a primeira atividade da parceria ABES-BID foi um passo importante para a regulação do setor de saneamento no cenário brasileiro. “Esse trabalho todo que se fortalece a partir desse primeiro workshop visa tentar – essa é a palavra que podemos usar no inicio – fazer com que regulação seja reconhecida no Brasil como, de fato, um dos instrumentos que podem levar à universalização da prestação dos serviços, aplicação dos serviços de qualidade e à melhoria da gestão”, salientou. “Então, acredito que, em resumo, a ABES hoje fez um ato histórico de conseguir, aproveitando o apoio imprescindível do BID, que financia todo esse trabalho, dar partida no fortalecimento no setor da regulação no país.”
O secretário Nacional de Saneamento, Paulo Ferreira, explicou que o Brasil ainda engatinha no quesito regulação. “Por enquanto não temos clareza no caminho adequado para a regulação. Estamos tateando neste processo”, pontuou. “Um processo importante que precisa ser implementado com certa rapidez. Estamos atrasados, mas estamos caminhando. A sociedade tem de ter uma participação efetiva e muito forte porque ela vai dar um norte para que o administrador faça seu trabalho de maneira mais adequada.”
O superintendente técnico da Câmara de Regulação da Agência Reguladora de Saneamento e Energia do Estado de São Paulo – ARSESP, Alberto Bovo, um dos palestrantes do encontro, enfatizou que, para efeito da regulação, a capacitação é fundamental. “A capacitação para a área de saneamento, de regulação é carente e acredito que esta vá contribuir muito com as agências reguladoras do Brasil”, completou.
Sobre sua participação, Bovo agradeceu a possibilidade de integrar efetivamente o projeto. “O desafio que temos que avaliar é que as agências reguladoras são novas e nem todas têm recursos, pessoal e técnico, o que vai demandar um trabalho bem exaustivo, mas vai compensar.”
O presidente da Associação Brasileira das Concessionárias Privadas dos Serviços Públicos de Água e Esgoto – ABCON, Roberto Muniz, destacou que a governança regulatória é fundamento básico para qualquer tipo de anseio relacionado ao setor de saneamento e base para o crescimento sustentável. “Queremos ampliar a nossa participação porque entendemos que esse debate abre um grande momento. Entendemos que esse trabalho será um marco importante para o futuro do saneamento no Brasil.”
Claudia Lins, assessora técnica em Saneamento e Meio Ambiente da Confederação Nacional dos Municípios, afirmou que esta é uma oportunidade ímpar tanto para o Governo Federal/Ministério das Cidades como para a sociedade e para a ABES. “O tema de regulação está crescendo e é o momento de trazermos todos os atores envolvidos, inclusive a sociedade civil, a área acadêmica também é muito importante”, pontuou.
É necessário, segundo Cláudia, cada vez mais levar a compreensão dos desafios e a realidade que o saneamento traz. “São desafios muito específicos e eles não são iguais para cada região do país, lembrou. O serviço de saneamento básico em São Paulo é diferente de Manaus, por exemplo. E como podemos fazer a regulação no setor diante de realidades tão distintas?”, questionou.
Do ponto de vista de Aparecido Hojaij, presidente da Associação Nacional dos Serviços Municipais de Saneamento – Assemae, não existe necessariamente um arranjo institucional melhor que outro para regular setor de saneamento básico. “O que deve haver é um experimentalismo regulatório para que possamos identificar o melhor modelo para cada caso, considerando todas as questões da indústria do saneamento”, defendeu.
Essa agência, explicou, pode ser tanto municipal como intermunicipal e deve levar em conta as características do município, que é o objeto da regulação, e a divisão geopolítica – as fronteiras. “Nós entendemos, além dessa questão do experimentalismo, que atualmente o modelo municipal e o consorcial parecem ser os mais adequados por aquilo que temos acompanhado e avaliado”, afirmou. E acrescentou: “Mais importante do que a abrangência da agência é que sua regulação decorra de um ato soberano do município, que é titular do serviço, e que a agência esteja ligada aos interesses locais – jamais submetida, estruturada e organizada pelo Estado ou pela União. E é com essa visão que a Assemae pretende começar a estudar esse processo.”
Segundo Fernando Alvarez, diretor executivo da Siglasul, empresa contratada para fazer a consultoria do projeto ABES BID, o setor de saneamento tem grandes desafios, particularmente de governança, e a regulação traz ainda novos desafios para melhorar a eficiência do setor. “A regulação é um tema novo e no Brasil já há um histórico em outras disciplinas, como, por exemplo, a energia elétrica ou gás, e agora o saneamento é a bola da vez”, argumentou. “Isso requer um padrão de formar pessoas que tenham conhecimento dos aspectos que vão além dos técnicos específicos, que têm conhecimentos econômicos, técnicos e legais/jurídicos e por isso importância de munir o setor com essa base de conhecimento que vai viabilizar uma melhoria na gestão.
Leonardo Campos, diretor de projetos, também da Siglasul, explicou que a capacitação do saneamento é uma das etapas de implantação dos objetivos da lei que serve para tornar o setor mais apto para a regulação, para discutir com a sociedade e demonstrar a relevância fundamental do saneamento. “A Lei 11.945 trouxe objetivos amplos e uma série de questões, além da necessidade de coordenação em nível muito elevado. Então, necessitamos agora levar a lei do alto da fábrica para o chão da fábrica, fazer com que ela atravesse todo o setor e todos comecem a comungar conceitos de ter capacidade crítica e de implementação.”
Participação do público
O workshop despertou no público o interesse por um aprofundamento nas questões de regulação.
Na opinião de Walter Maurício, da área de manutenção e operação da CEDAE –Companhia Estadual de Águas e Esgotos, o tema mais interessante do workshop foi sobre legalização de contratos, concessionárias, o poder concedente. “Foi o que mais me chamou atenção porque falou sobre plano de saneamento, fiscalização e agências reguladoras. Mas, em geral, eu gostei bastante.”
Walter Lorenzo Filho Mota de Souza, que trabalha na Gerência de Fiscalização Operacional da Agência Reguladora do Serviço de Água e Esgoto de Minas Gerais – ARSAE-MG, lembra a qualidade dos palestrantes. “O tema da regulação é muito importante porque é pouco conhecido dos cidadãos e será bom para os usuários saberem dos seus direitos”, disse ele. “No caso das Agências Reguladoras é importante para elas conseguirem avançar no seu modo de atuação. Isso ainda é novo e temos poucas experiências para compartilhar. Então ter esse tipo de capacitação com certeza vai trazer novas ideias. Eu tenho bastante interesse em participar do curso.”
Cristiane Schwanka, gerente da Assessoria de Planejamento Estratégico da Sanepar – Companhia de Saneamento do Paraná, também gostou do que viu e ouviu no workshop e agora aguarda pelo curso a distância. “Fiquei feliz que o projeto esteja caminhando e assim podemos ter acesso às informações. Estamos mesmo precisando trabalhar essa questão e esse fomento do BID veio em boa hora para podermos discutir mais as experiências e ter essa questão de visões diferentes e quero, sim, participar do curso”, enfatizou.
As etapas seguintes do projeto serão divulgadas neste site nacional da ABES e nas redes sociais e publicações da Associação.
