MP do Saneamento: intransigência do governo impede acordo e Medida 844 perde a validade

A MP 844/2018, que trata da alteração do marco regulatório do setor de saneamento, não foi votada em 13 de novembro e perdeu efeito após esta segunda-feira, dia 19. Com isso, o setor de saneamento vê afastada a ameaça de desestruturação, que se baseia na economia de escala e no subsídio cruzado.

A ABES, juntamente com Asseame, AESBE, ABAR, ABM, FNU, FNP, FNSA e outras entidades da sociedade civil, contrárias à MP, tentaram negociar com o Governo Federal a exclusão dos artigos 8A, 8B e 10A, sem sucesso: instantes antes da votação, no dia 13, foi feita proposta, porém o governo deu resposta às demandas apenas às 17h, não restando tempo hábil para o consenso dos partidos políticos.

A ABES vinha alertando – e buscando dialogar com o Governo Federal – desde novembro de 2017 para o fato de que a proposta de revisão do Marco Legal do Saneamento do Ministério das Cidades poderia desestruturar totalmente o setor no Brasil. A entidade colocou o tema em pauta, quando participou de reunião, naquele mês, com o Ministério das Cidades para discutir a revisão. A ABES já havia enviado ao então ministro das Cidades, Bruno Araújo, carta em que sugeria duas ações imediatas ao Ministério (leia aqui). E havia defendido, no encontro em Brasília, as propostas contidas no documento CONTRIBUIÇÕES DA ABES A MINUTA APRESENTADA PARA ALTERAÇÃO DA LEI 9.984/00 E LEI 11.445/07 (leia aqui ).

A Associação, juntamente com outras entidades, lançou a campanha Somos contra a MP do Saneamento para conscientizar a sociedade e mobilizar o setor. O dia 31 de julho ficou marcado em todo o Brasil como o DIA NACIONAL CONTRA A MP DO SANEAMENTO (leia aqui), com manifestações dos profissionais do setor nas capitais brasileiras, organizadas pelas seções estaduais da ABES. Representantes das associações participantes do movimento integraram diversos debates em eventos de saneamento no país, esclarecendo sobre a MP.  A entidade também foi convidada por vários veículos de imprensa a esclarecer o tema (veja reportagem aqui)

Dia Nacional Contra a Mp do Saneamento: mobilização em todo o Brasil

A ABES também enviou cartas a todos os prefeitos brasileiros esclarecendo sobre a MP e solicitando que as autoridades conscientizassem seus parlamentares.

Neste mês de novembro, a Associação lançou uma campanha online que engajou o setor e a sociedade a enviar aos parlamentares sua manifestação contra a MP 844. Cerca de 110 mil mensagens foram enviadas por meio da campanha online.

A ABES também divulgou à sociedade o Estudo de Caso do Amazonas, que demonstra que, após 20 anos da separação da capital da operação do saneamento do resto do estado (a proposta que a MP previa para todo o país), o Amazonas apresenta os piores índices sanitários do Brasil (veja aqui o estudo)

Próximos passos

A ABES convidou as principais entidades do setor para uma mesa e debate na Rio Water Week, para pensar o futuro do saneamento no Brasil e iniciar a negociação para um novo texto de melhoria ao futuro governo federal. O evento internacional Rio Water Week será realizado de 26 a 28 de novembro, no Riocentro, no Rio de Janeiro.
