Carta de Curitiba

Ao realizarmos o 31º Congresso Brasileiro de Engenharia Sanitária e Ambiental em Curitiba, infelizmente ultrapassamos os seiscentos mil óbitos decorrentes da Covid 19, estando o Brasil como o segundo país do mundo com mais mortes causadas pela pandemia. O progressivo avanço da vacinação coloca perspectivas de uma certa normalização do cotidiano. Permanecem, no entanto, os nefastos efeitos da pandemia sobre a saúde, o emprego e a renda da população brasileira, sobretudo da parcela mais pobre e mais vulnerável, trazendo ameaças à sobrevivência de milhares de famílias.

Às crises sanitária e social vem se somar a crise hídrica e ambiental que ameaça o suprimento de energia elétrica e o abastecimento de água em várias áreas do país, nas regiões Sul, Sudeste e Nordeste.

Neste quadro preocupante em que a ABES – Associação Brasileira de Engenharia Sanitária e Ambiental – realiza seu 31º Congresso, é nosso dever chamar a atenção para questões prementes relacionadas ao saneamento e ao meio ambiente, particularmente neste momento em que se discute a implementação do novo marco legal do setor.

Quando falamos em universalização do acesso aos serviços de saneamento é preciso ter claro que universalizar é atender as parcelas mais vulneráveis da população, que vivem em condições precárias de habitação, o que exige políticas integradas, que vão além dos limites dos contratos de prestação de serviço. Quanto aos contratos, é necessário facilitar a ligação dos domicílios e implementar tarifa social compatível com a situação econômica das famílias, assegurando o direito a serviços de qualidade, com equidade de condições de acesso.

A implementação do novo marco regulatório precisa ser feita com mais negociação, em lugar de ações impositivas, especialmente aquelas que venham a resultar na desestruturação das instituições existentes. É necessário estabelecer um processo de transição, especialmente no que diz respeito aos prazos de comprovação de capacidade econômico-financeira dos prestadores, que devem ser adequados aos da agenda regulatória estabelecida pela Agência Nacional de Águas e Saneamento Básico e aos da implantação dos processos de governança regional.

O saneamento brasileiro encontra-se sob riscos de atrasos no alcance da universalização do acesso aos serviços pela insegurança jurídica decorrente das várias contestações ao modo como as mudanças vêm sendo interpretadas e implementadas. A ameaça de paralisia e do retrocesso nos índices de atendimento também vem da interrupção das fontes públicas de financiamento, que devem ser retomadas de imediato.

Nas novas licitações de concessão de serviços, a ABES propõe que as outorgas sejam limitadas, pagas ao longo dos ciclos contratuais, e tenham sua aplicação necessariamente vinculada ao setor, em ações como saneamento integrado em áreas subnormais, por exemplo. Assim, se dará prioridade à modicidade tarifária, e, muito importante, se evitará a evasão de recursos de um setor deficitário, como é o de saneamento.

O desmonte do Sistema Nacional de Meio Ambiente, com o enfraquecimento do CONAMA e dos mecanismos de licenciamento ambiental, combinado com a omissão no combate ao desmatamento e a falta de políticas de enfrentamento das alterações climáticas, comprometem um futuro mais sustentável. Continuam prementes soluções sustentáveis e abrangentes para a gestão dos resíduos sólidos urbanos levando em conta a economia circular, bem como soluções inteligentes de drenagem urbana.

Ao seu turno, o enfrentamento da crise energética não pode ser feito à custa da destituição das atribuições do Sistema Nacional de Recursos Hídricos, concentrando as decisões em flagrante desrespeito à gestão democrática e participativa que a legislação federal preconiza.

O enfrentamento dos desafios atuais e futuros na busca de sustentabilidade social ambiental e econômica se apoia no desenvolvimento tecnológico e na inovação. A desestruturação da pesquisa e da pós-graduação nos institutos de pesquisa e nas universidades brasileiras e a crise orçamentária por que passam as instituições federais de ensino e pesquisa precisam ser revertidas.

A busca pela universalização sustentável e acessível a todos dos serviços públicos de saneamento básico é tarefa urgente que deve ser enfrentada com a participação de toda a sociedade brasileira, de forma democrática, transparente e solidária. Da mesma forma cabe enfrentar os problemas ambientais e de saúde coletiva que afligem o Brasil atual.

É preciso que a visibilidade que o saneamento básico adquiriu ajude a fortalecer e fazer evoluir o setor, prevenindo os riscos de estagnação, ou mesmo de retrocesso, das estruturas atuais de prestação dos serviços. A chave para o sucesso é apostar em menos imposições e mais negociação nos processos de transição.

Nesta conjuntura, marcada por incertezas de diversas ordens não só na gestão do saneamento, do meio ambiente e dos recursos hídricos, mas, especialmente, com a insegurança jurídica na interpretação da legislação recente, a ABES, em seu 31º Congresso de Engenharia Sanitária e Ambiental, reafirma seu compromisso de continuar trabalhando pelo desenvolvimento do saneamento ambiental e pela melhoria da qualidade de saúde e de vida da população.
