CARTA DE BELO HORIZONTE

A ABES- Associação Brasileira de Engenharia Sanitária e Ambiental – realizou seu 32º Congresso, em Belo Horizonte, de 21 a 24 de maio de 2023. O mais importante fórum do saneamento ambiental brasileiro, há seis décadas convergindo as discussões técnico-científicas e institucionais desse setor, teve nesta uma de suas maiores edições, com mais de 7.000 participantes, sendo 3.500 delegados, ocupando 19 salas simultâneas, em 60 painéis temáticos e mais de 1.000 trabalhos técnicos apresentados. A feira técnica ocupou 9.000 m² de área, sendo 3.600m² de estandes.

O Congresso se realizou em um momento de retomada de políticas ambientais responsáveis, o que foi reconhecido e valorizado pelos congressistas. O avanço das evidências de mudanças climáticas, exigindo medidas de controle e de aumento da resiliência dos sistemas hídricos para enfrentar eventos extremos de seca e de inundações; as ameaças aos biomas, à Amazônia, mas também à Mata Atlântica, ao Cerrado, à Caatinga, ao Pantanal, e a outros, reclamam dos governos ações comprometidas com o presente e com o futuro. Nos dias posteriores ao Congresso, no entanto, decisões de redução das prerrogativas e instrumentos dos órgãos de controle ambiental trouxeram preocupação aos profissionais do saneamento ambiental. A ABES entende que essas prerrogativas e esses instrumentos precisam ser restaurados.

O tema do 32º Congresso Brasileiro de Engenharia Sanitária e Ambiental, Saneamento Ambiental: Desafios para a Universalização e a Sustentabilidade, permeou os debates. Uma primeira conclusão importante refere-se à capacidade do país para promover as ações necessárias à universalização. O Brasil tem tecnologia e conhecimento necessários, mas é preciso formar mais quadros técnicos, e para isso, recuperar as universidades públicas. E é também necessário recuperar e ampliar a capacidade das empresas de engenharia e das produtoras de insumos, para atender o aumento de investimentos, indispensável para alcançar as metas definidas em lei.

A gestão da drenagem pluvial urbana segue sendo o segmento com mais problemas, por ser um serviço não associado a tarifa no arranjo institucional brasileiro, o que leva a situação crônica de subfinanciamento. O aumento dos eventos extremos provocado pelas mudanças climáticas, demandando intervenções além dos parâmetros tradicionais de dimensionamento dos sistemas, agrava essa situação. Por outro lado, cresce no país a adoção de soluções voltadas à redução de vazões superficiais e de melhor gestão com intervenções não estruturais, o que deve ser saudado como importante avanço. Da mesma forma, cresce a compreensão de que a gestão integrada de drenagem pluvial e esgotamento sanitário é imprescindível para ações de despoluição plena de áreas de grande densidade de ocupação.

Na gestão de resíduos sólidos verifica-se o aprofundamento da adoção do conceito de economia circular, com o fortalecimento das práticas de reciclagem e de logística reversa. Nas ações de reciclagem é necessário incluir os catadores e dar-lhes voz na definição das soluções. Embora haja avanços, persiste grande número de lixões em muitos municípios do país. A ABES reafirma seu compromisso com o movimento “Brasil, te quero livre de lixão”.

Na discussão da universalização do atendimento por serviços de abastecimento de água e de esgotamento sanitário é importante partir de análises realistas, que não simplifiquem os problemas. Grande parte dos déficits se encontra nas áreas de mais difícil atendimento, as periferias das grandes metrópoles, as áreas rurais, as pequenas comunidades. É necessário um planejamento cuidadoso e buscar soluções negociadas, combinando as capacidades existentes. Hoje existe um segmento de prestadores privados com capacidade técnica e de endividamento para assumir serviços em Parcerias Público-Privadas e em concessões diretas. O reconhecimento dessa realidade não deve implicar a redução da importância das empresas estaduais de economia mista como grande vetor de expansão e de desenvolvimento tecnológico do setor. E é necessário salientar a importância de serviços municipais em muitos municípios médios e grandes, com o alcance de níveis elevados de atendimento. A combinação das capacidades, e não a tentativa de impor soluções coercitivas é que poderá abrir o caminho de avanço.

Outra condição para o avanço é a regulação da prestação de serviços. Como monopólios naturais, os serviços de saneamento ambiental necessitam de regulação capaz e independente, para que se deem as condições de eficiência, qualidade e modicidade tarifária. Houve grande desenvolvimento da cultura de regulação no setor nas últimas duas décadas, mas há ainda muito por fazer. A Agenda Regulatória, estabelecida pelo novo marco do setor, vem sendo desenvolvida pela Agência Nacional de Águas e Saneamento Básico com processos abertos de discussão, como é necessário que seja, verificando-se a necessidade de tempo de maturação, o que contraria prazos muito ambiciosos. Em nível infranacional, faz-se necessário continuar aprimorando governança, capacidade técnica e independência decisória das agências existentes. Segurança jurídica, normas claras e estáveis para atração de investimentos serão atingidos com a soma de esforços dos diferentes atores deste processo.

Serviços de saneamento necessitam financiamento público. É animador o crescimento do financiamento privado no setor, mas não há como abrir mão das fontes públicas, principalmente o FGTS e o BNDES; o acesso a essas fontes precisa ser simplificado e aberto a todos os agentes do setor, sem restrições. Além de recursos financiados, há necessidade de recursos não onerosos, uma vez que nem todos os serviços são passíveis de terem seus custos recuperados por tarifas, ou por subsídios cruzados. Apesar da crise fiscal, um nível mínimo é necessário, e sua aplicação deve ser rigorosamente destinada a usuários sem condição econômica e a serviços não viáveis.

Em um setor deficitário e carente de recursos fiscais é absurda, como a ABES tem insistentemente denunciado, a prática de licitações de concessão com outorgas vultosas, destinadas a outros usos. Outorgas devem ser limitadas, do contrário comprometerão a modicidade das tarifas; devem ser distribuídas ao longo do fluxo contratual, e não usadas para seduzir os governantes de turno; e devem ser vinculadas obrigatoriamente ao setor de saneamento.

As discussões do Congresso deixaram claro que falar efetivamente em universalização significa discutir o atendimento das pessoas que mais precisam, onde é mais difícil prestar o serviço. O acesso a serviços de qualidade é direito de todos, por tarifas adequadas a sua situação econômica.

O Brasil é um país de renda média, que poderia ter toda sua população morando em condições adequadas. A má distribuição dessa renda, no entanto, leva a que cada vez tenhamos mais pessoas morando em favelas, ou em situação de rua. Só haverá universalização quando essas pessoas forem atendidas por serviços de qualidade. A solução definitiva será a urbanização das áreas informais, mas enquanto isso não se viabilize, soluções de serviços de saneamento deverão ser providas. 

É necessário estruturar políticas de atendimento para as áreas rurais. O Brasil tem boas experiências, com excelentes resultados, que devem ser sistematizadas e transformadas em políticas gerais, respeitadas as diferenças regionais.

Um dos objetivos do novo marco do saneamento é que os serviços sejam prestados a partir de bons contratos, com metas claras e auditáveis. Esses contratos devem incluir o atendimento às áreas informais e a assistência técnica ao saneamento rural. Nem tudo, no entanto, é possível incluir nos contratos, como é o caso do saneamento integrado das áreas de ocupação informal e o subsídio a sistemas de saneamento rural. Para esses casos são imprescindíveis recursos fiscais, e aí deve ser uma das destinações de recursos de outorgas vinculados ao setor.

O 32º Congresso Brasileiro de Engenharia Sanitária e Ambiental cumpriu mais uma vez o papel de ser o grande foro nacional de divulgação técnica e científica, discussão institucional, integração entre profissionais e difusão de conhecimento do setor de saneamento ambiental. A ABES realizou sua missão e, mais uma vez reiterando a unidade de ação com as demais entidades do setor, reafirma seu compromisso com o saneamento, a saúde pública, o meio ambiente, e a gestão de recursos hídricos, na busca da construção de um país mais justo e sustentável.
