Importantes resoluções do Conama são derrubadas em reunião extraordinária

Mudanças na legislação, que abrem espaço para especulação imobiliária nas praias e ocupação de mangues para produção de camarão foram aprovadas nesta última segunda-feira, 28 de setembro, na reunião extraordinária do Conama.  Foram derrubadas as resoluções 302 e 303 que delimitavam áreas de proteção permanente (APPs) de manguezais e de restingas.

Também foi aprovada uma resolução Conama que trata de critérios de incineração de resíduos em fornos de produção de cimento e que é objeto de nota específica da Câmara Temática de Resíduos Sólidos da ABES, (veja neste link). Não deixem de conhecer esse importante posicionamento!

E tudo isso em regime de urgência, sem que esses temas tivessem sido submetidos a estudos, nas câmaras técnicas, aos especialistas dos órgãos ambientais e da sociedade civil e ao conhecimento do público interessado. Por quê?

O Conama, que sempre teve papel fundamental na definição de normas e critérios da área ambiental do país, teve sua estrutura modificada em junho do ano passado e, com isso, o poder de decisão do colegiado ficou ainda mais concentrado nas mãos do governo federal.

O Conama – que é um órgão consultivo e deliberativo, que estabelece normas e critérios na área ambiental – foi desidratado no ano passado em relação à sua composição e representatividade, ficando ainda mais concentradas nas mãos do governo federal as decisões.

Estados e entidades civis perderam representação. O Conama teve seus membros reduzidos de 96 para 23. A ABES já tinha manifestado preocupação com essa mudança no ano passado, ressaltando a importância da participação da sociedade no Colegiado, da representatividade de todos os segmentos.

Instituições que representam a sociedade civil, incluindo associações de trabalhadores rurais e povos indígenas, viram suas posições caírem de 23 para 4.

Além disso, uma parte dos integrantes da sociedade era escolhida por indicação e outra, por eleição, mas, desde o ano passado, essa escolha passou a ser feita por sorteio.

Os Estados também perderam representação. Se antes havia uma cadeira para cada um dos 26 Estados e o Distrito Federal, agora são 5 cadeiras representadas por um Estado de cada região geográfica do País. Os municípios, que tinham 8 representantes, agora têm 2.

Todas as resoluções ambientais merecem uma discussão aprofundada, que sem uma abordagem técnica multidisciplinar pode resultar em um esvaziamento das regras ambientais protetivas que precisamos. Resoluções existentes não deveriam ser objeto de simples revogação, mas sim de aprimoramento, com debate técnico, científico e democrático, dons irrefutáveis que a lei conferiu ao Conama e que devem ser resguardados por todos nós.
