ABES e Ministério Público promovem debate em São Paulo sobre a universalização do saneamento

O presidente nacional da ABES foi um dos mediadores, nesta quarta-feira, 25, dos debates do seminário “Saneamento Básico em São Paulo e no Brasil – Como chegar à universalização e o desafio das áreas irregulares”, promovido pelo Ministério Público de São Paulo em parceria com a ABES e outras entidades, como a Aesbe e o Instituto Trata Brasil.

Dante, que é superintendente de Planejamento Integrado da Sabesp, mediou a discussão que teve como tema “O Cenário do Saneamento no Estado de São Paulo e no Brasil: a visão dos envolvidos – desafios e como avançar”, juntamente com Luis Felipe Tegon Cerqueira Leite, promotor de justiça do Centro de Apoio Operacional do Meio Ambiente, Habitação e Urbanismo do MPSP. A mesa foi composta por Paulo Massato Yoshimoto, diretor da Sabesp para a Região Metropolitana, Roberto Tavares, presidente da Aesbe (Associação Brasileira das Empresas Estaduais de Saneamento) e Ivan Carneiro Castanheiro, promotor de justiça do GAEMA (Grupo de Atuação Especial do Meio Ambiente) da Bacia do PCJ (Piracicaba, Capivari e Jundiaí).

Ivan Castanheiro abordou as questões relacionadas à gestão de recursos hídricos, destacando as ações necessárias para recuperação e conservação dos recursos hídricos, em especial na Bacia do PCJ. O promotor também defendeu que o adiamento da renovação da outorga do Sistema Cantareira pela ANA (Agência Nacional de Águas) para 2017 permitirá uma melhor análise das condições da crise. Já Roberto Tavares falou sobre a atuação da Aesbe e da situação precária encontrada em diversos municípios brasileiros, em especial no Nordeste, quando o assunto é saneamento básico.

Paulo Massato, por sua vez, apresentou dados gerais da Sabesp, demonstrando a complexidade e a integração da companhia, e destacou que um grande desafio para o saneamento é o crescimento desordenado das grandes cidades, o que dificulta o planejamento nas áreas urbanas.

O diretor também exibiu informações relativas a combate a perdas, atuação comercial, operação, gestão da empresa, captação e alocação de recursos e governança. No encerramento de sua apresentação, defendeu a importância de gerir bem os recursos, pelo fato da Sabesp não contar com subsídios estatais. “Nós temos a quinta menor tarifa do Brasil, mas mesmo assim conseguimos manter os investimentos durante a crise hídrica. Hoje, a maior parte do orçamento da Sabesp é alocado na redução de perdas. Isso só é possível pois a Sabesp é uma companhia sadia”, afirmou.

Para Dante, a iniciativa promovida em parceria com o Ministério Público, que já vem ocorrendo em outros estados brasileiros, é bastante significativa. “O Ministério Público é um importante ator na luta pela melhoria do saneamento brasileiro. Por isto, firmamos esta parceria e temos feito contatos com a instituição em diversos estados do Brasil. Aliás, estiveram debatendo com o setor nos nossos dois últimos congressos”, ressaltou.
Mutirão da cidadania

Na parte da tarde, o seminário teve a presença do presidente da Sabesp, Jerson Kelman, q2ue participou do debate sobre “Saneamento Básico em Áreas Irregulares – a visão técnica e o olhar do cidadão”, baseado em levantamento realizado pelo Instituto Trata Brasil em 13 cidades paulistas (12 delas operadas pela Sabesp).

Ao fim do evento, os participantes se comprometeram a assinar um documento para formar um grupo de trabalho. Kelman sugeriu que seja criada um “mutirão da cidadania” envolvendo as prefeituras, Sabesp e também a Cetesb e a Pastoral da Criança – que estiveram presentes ao evento – para regularizar a situação de áreas ocupadas.

“O primeiro passo é definir quais são as comunidades que podem ser regularizadas e quais não podem ser. A Sabesp está se apresentando para trabalhar junto. É preciso envolver os municípios, que têm uma renda específica para regularizar áreas. Em São Paulo, por exemplo, esse valor é de cerca R$ 300 milhões por ano. Não é um dinheiro que o município possa aplicar em outras atividades. Quanto maior a visibilidade disso, melhor. Se todos os administradores forem inteligentes e absolutamente probos, vai funcionar”, defendeu Jerson Kelman.

Além do presidente Kelman, o debate contou com a presença do promotor de justiça do meio ambiente Ricardo Manuel Castro, de Vivian Marrani Marques, assessora de Licenciamento e Controle Ambiental da Cetesb e de Daniel Zampieri, coordenador da Pastoral da Criança. O promotor afirmou em sua apresentação que a água vem sem sendo tratada como mercadoria, quando na verdade é um bem público. Criticou o fato de a Sabesp ter distribuído parte do lucro aos acionistas e afirmou que a companhia teria deixado de investir R$ 815 milhões em 223 municípios por conta desses dividendos.

Castro também apresentou sugestões para as áreas irregulares: congelamento das áreas pelas prefeituras; cadastramento rigoroso dos moradores; políticas habitacionais para realocação das famílias; recuperação ambiental das áreas de proteção; medidas temporárias para evitar o agravamento da poluição decorrente das ocupações; e envolver no processo a população diretamente atingida.

Na sequência, o presidente Kelman aproveitou sua apresentação para esclarecer que a Sabesp repassa aos acionistas o valor mínimo exigido pela legislação, que é de 25% do lucro, sendo o restante utilizado para investimentos. Kelman também lembrou que o Governo do Estado é o acionista majoritário, portanto, boa parte desse montante volta para a própria população. Ainda sobre o tema, o presidente citou que a Sabesp investiu cerca de R$ 3 bilhões por ano nos últimos anos e que a fonte de receita da empresa é a arrecadação com tarifas, por não depender de subsídios estatais.

Sobre as áreas irregulares, Kelman disse que as pessoas que moram nesses locais não podem ficar desabastecidas, mas a legislação impede que as autarquias de saneamento regularizem o abastecimento em regiões ocupadas. O presidente ressaltou que a Região Metropolitana de São Paulo possui 411 mil ligações irregulares, todas elas abastecidas com água. Em caso de regularização, a Sabesp seria cobrada pela coleta e tratamento de esgotos e muitas das ocupações ficam localizadas em fundos de vale, o que impede a implantação de coletores-tronco para evitar a despoluição dos rios.

Para finalizar, Jerson Kelman lembrou que esse é um trabalho a ser feito a longo prazo. “Os rios Potomac, em Washington, e Sena, em Paris, demoraram 50 anos para serem despoluídos em cidades onde não há ocupações irregulares. Aqui, muito já foi feito, mas os investimentos vultuosos devem continuar por muitos anos para que possamos utilizá-los no futuro.”
