Comitês de Bacias hidrográficas manifestam-se contra projeto de lei que propõe redução na distribuição financeira pelo uso de recursos hídricos

Na última sexta, dia 23 de junho, representantes dos Comitês de Bacias Hidrográficas, legalmente instituídos no âmbito do Sistema Nacional e Estadual de Recursos Hídricos, encaminharam ofício ao presidente do Senado Federal, Eunício Oliveira, manifestando posição contrária ao Projeto de Lei da Câmara nº 315/2009 (PLC 315/2009).

De acordo com o documento do Fórum Nacional de Comités de Bacias Hidrográficas – FNCBH, o objetivo do PLC é alterar a distribuição da compensação financeira pela utilização de recursos hídricos, definida na Lei nº 8.001, de 13 de março de 1990. Nesta lei, os percentuais de distribuição estão divididos da seguinte maneira: 45% dessa compensação é destinada aos estados, 45% aos municípios, 3% ao Ministério de Meio Ambiente, 3% ao Ministério de Minas e Energia, e 4% ao Fundo Nacional de Desenvolvimento Científico e Tecnológico (FNDCT).

Já o Projeto de Lei nº 315, de 2009, propõe que os municípios recebam 65% e, os estados, 25%. Com as mudanças propostas pode-se ocasionar o desmonte de Sistemas de Gerenciamento de Recursos Hídricos.

A moção do FNCBH nº 38/2016 reafirma a posição contrária do Fórum ao Projeto de Lei da Câmara nº 315/2009.

Na visão da coordenadora da Câmara Temática de Gestão de Recursos Hídricos da ABES, Célia Regina Alves Rennó, o Projeto de Lei da Câmara 315/2009 pode influenciar negativamente na gestão das águas no país.  “Simplesmente mudar os percentuais, reduzindo repentinamente os recursos que vão para os estados, que já têm diversas ações acontecendo para a gestão das águas (monitoramento, realização de planos etc.) e que se utilizam e contam com esses recursos pode inviabilizar muitas ações e programas no sistema e ter um efeito negativo imediato na gestão das águas”, afirma.

“A nova distribuição de recursos”, explica Célia, “deve ser discutida entre todos os atores com a redistribuição de atribuições e responsabilidades dentro do Sistema de Recursos Hídricos, de forma a maximizar seus efeitos positivos e não vimos acontecendo esse tipo de discussão.”
