A Regulação, sua importância e seus impactos estão na programação de debates do 32º Congresso Brasileiro de Engenharia Sanitária e Ambiental (CBESA) – o Congresso da ABES. A agenda regulatória, o planejamento e regulação dos serviços de resíduos sólidos e o papel das agências serão aprofundados no mais importante evento de saneamento ambiental do Brasil, realizado pela ABES (Associação Brasileira de Engenharia Sanitária e Ambiental) entre os dias 21 e 24 de maio, no Expominas, em Belo Horizonte/MG.
O primeiro encontro que abordará a temática será no dia 22 (segunda-feira), às 14h15, com Demétrius Jung Gonzalez, diretor-geral da Agência Reguladora Intermunicipal de Saneamento do Rio Grande do Sul (Agesan-RS). No “Diálogo Setorial 2: Planejamento e Regulação dos Serviços de Resíduos Sólidos Urbanos”, Gonzalez apresentará e discutirá os principais desafios e necessidades para o planejamento e regulação dos serviços de resíduos sólidos urbanos.
O novo Marco Regulatório trouxe significativas mudanças e responsabilidades aos agentes públicos relacionados aos serviços de RSU, propiciando um ambiente de ampliação do número de concessões e PPPs. Neste contexto, uma das principais premissas é a necessidade de comprovação, pelos municípios, da sustentabilidade para prestação dos serviços, incluindo a destinação adequada dos rejeitos.
No dia 23 (terça-feira), às 10h15, Rui Cunha Marques, professor catedrático do Instituto Superior Técnico da Universidade de Lisboa/Portugal, e Marcel Costa Sanches, superintendente de Assuntos Regulatórios da Sabesp, debaterão “O papel das Agências na Regulação Contratual (Câmara Temática de Regulação e Tarifa)”. O objetivo é apresentar e discutir as atividades regulatórias das Agências no contexto da regulação contratual.
Em um cenário de ampliação do número de concessões, criado com o novo Marco Regulatório, há a vedação de novos contratos de programa. Com isso, existe expectativa de mudança do contexto regulatório em direção ao modelo de regulação contratual, considerando que as regras da concessão estarão pré-definidas nos contratos, inclusive os aspectos tarifários.
Também na terça, às 14h15, o diretor-executivo da ABCON SINDCON (Associação e Sindicato Nacional das Concessionárias Privadas de Serviços Públicos de Água e Esgoto), Percy Soares Neto, é o palestrante do “Diálogo Setorial 7: Agenda Regulatória”, que abordará a importância das Normas de Referência para a estruturação do setor de saneamento de modo organizado, com base em regulação da prestação de serviços eficaz e confiável, dando segurança jurídica à realização dos contratos.
Para Marisa Guimarães, coordenadora da Câmara Temática de Regulação da ABES e diretora da ABES-SP, a nova lei de saneamento, em vigor desde 2020, estabeleceu metas para a universalização da prestação dos serviços de água e esgotos para 2033. Portanto, debater regulação com os diversos atores – municípios, estado, reguladores e prestadores de serviço – é fundamental na construção da regulação e no amadurecimento da compreensão da regulação do setor.
“A lei estimula fortemente a participação do setor privado a participar do processo, além das empresas estaduais e dos municípios. Os prestadores de serviço são escolhidos por licitações e todas suas obrigações devem estar contidas em contratos. A regulação e fiscalização dos serviços são extremamente importantes no processo de universalização, garantindo a qualidade da prestação dos serviços. Trata-se de monopólio natural, o que torna mais importante ainda a função da regulação. Além da regulação de água e esgotos, o Congresso trará a discussão sobre regulação de resíduos sólidos, e as últimas evoluções sobre regulação de drenagem urbana e saneamento rural, que se iniciaram recentemente no meio técnico. Nossa expectativa é que, através do debate e troca de experiências, possamos contribuir para o desenvolvimento da regulação no país”, avalia Marisa.
