O Ministério do Desenvolvimento Regional publicou, nesta quinta, dia 7 de março, a Instrução Normativa nº 7 e a Portaria 561, que tratam da revisão do Plansab e a realização de consulta e audiências públicas. A tarefa da FNSA é discutir como intervir nesse processo.

Art. 51. O processo de elaboração e revisão dos planos de saneamento básico deverá prever sua divulgação em conjunto com os estudos que os fundamentarem, o recebimento de sugestões e críticas por meio de consulta ou audiência pública e, quando previsto na legislação do titular, análise e opinião por órgão colegiado criado nos termos do art. 47 desta Lei.

Art. 58. O PNSB será elaborado e revisado mediante procedimento com as seguintes fases:
I – diagnóstico;
II – formulação de proposta
Art. 61. A proposta de plano ou de sua revisão, bem como os estudos que a fundamentam, deverão ser integralmente publicados na internet, além de divulgados por meio da realização de audiências públicas e de consulta pública.
Parágrafo único. A realização das audiências públicas e da consulta pública será disciplinada por instrução do Ministro de Estado das Cidades.

· A instrução normativa nº 7 de 26 de fevereiro de 2019 foi publicada no Diário Oficial da União em 7 de março de 2019;
· AUDIÊNCIA PÚBLICA: prevê a realização de audiência pública com o objetivo de: garantir à população o esclarecimento de possíveis dúvidas acerca da proposta em questão, bem como de coleta de críticas e sugestões à proposta de revisão do Plano, exclusivamente por escrito;
· Garante que serão realizadas pelo menos duas audiências públicas, sendo uma em Brasília;
· Na etapa da AUDIÊNCIA PÚBLICA, a proposta de revisão do Plano Nacional de Saneamento Básico estará disponível na rede mundial de computadores, no sítio eletrônico do Ministério do Desenvolvimento Regional, com pelo menos 05 (cinco) dias úteis de antecedência.
· CONSULTA PÚBLICA: etapa exclusivamente de coleta de sugestões e críticas à proposta de revisão do texto do Plano Nacional de Saneamento Básico, que subsidiará a elaboração da proposta final de revisão do Plano em questão, garantindo à população a oportunidade de encaminhar suas contribuições ao documento
· A CONSULTA PÚBLICA, permanecerá durante 30 (trinta) dias ininterruptos para receber contribuições a partir de 07/03/19;
· As contribuições serão de natureza: aditiva – que sugere acréscimo de texto; e supressiva – que sugere eliminação de texto ou parte dele.
· A PORTARIA Nº 561, DE 26 DE FEVEREIRO DE 2019, também publicada em 07/03/19 torna pública a realização de Consulta Pública sobre a revisão do Plano Nacional de Saneamento Básico – Plansab
