No dia 23 de outubro, a Siglasul, empresa contratada para elaborar o Plano Estratégico de Capacitação em Regulação e Implantação de Módulo de Ensino a Distância, participou do XXII encontro da Câmara Técnica de Saneamento Básico da Associação Brasileira das Agências de Regulação (CTSan-ABAR), realizada na sede da Agência Reguladora de Energia e Saneamento Básico do Estado do Rio de Janeiro – AGENERSA. Na ocasião, Luiz Fernando Alvarez e Leonardo Campos, diretores executivo e de projetos da Siglasul, respectivamente, apresentaram a 50 participantes de 20 agências o tema “1º Workshop do Projeto de Regulação para o Setor de Água e Saneamento”.
A ABAR congrega diversas agências reguladoras do país, não apenas de saneamento, mas também de energia elétrica, telecomunicações, transporte, petróleo, entre outras tantas, estaduais, municipais e intermunicipais. A palestra foi um resumo do conteúdo abordado durante o 1º Workshop do Projeto ABES/BID, que ocorreu no dia 5 de outubro, no âmbito do 28º Congresso Brasileiro de Engenharia Sanitária e Ambiental, realizado no Rio de Janeiro.
O encontro da Associação ocorre a cada dois meses. Segundo Alberto Bovo, superintendente técnico da Câmara de Regulação da Agência Reguladora de Saneamento e Energia do Estado de São Paulo – ARSESP, que teve a ideia de levar a palestra para a reunião da ABAR, o evento tem entre seus objetivos discutir a situação do setor no país. “A CTSan-ABAR reúne-se com a finalidade de apresentar os avanços ocorridos nas agências reguladoras, assim como debater os assuntos legais e infralegais relacionados à Regulação de Saneamento Básico no Brasil, além da possibilidade do network”, afirma.
A ABAR, de acordo com Bovo, considera que os trabalhos do projeto ABES/BID desenvolvidos até o momento “estão bem alicerçados e consistentes, por meio de dados e simulações, demonstrando o estágio atual da Regulação do Saneamento Básico no Brasil”.
O representante da ARSESP ressalta a importância da iniciativa. “Para a CTSan-ABAR, o fórum proporcionado pelo projeto ABES-BID é de extrema relevância na medida em que objetiva buscar o desenvolvimento da Regulação no Brasil por meio de capacitação e a avaliação da aplicação dos subsídios cruzados (tarifas), assim como a realização de estudos sobre indicadores para acompanhamento do desempenho e qualidade da prestação de serviços, abrangendo a universalização“, salienta. “Parabenizamos a iniciativa da ABES pela preocupação com o aprimoramento e desenvolvimento da Regulação do Saneamento Básico no Brasil.”
Segundo o Eng. Pedro Alexandre Moitrel Pequeno, do corpo de Engenheiros Reguladores da AGENERSA, gerente da Câmara de Resíduos Sólidos (CARES) da entidade e também membro da Câmara Temática de Resíduos Sólidos da ABES, além de ter feito parte da diretoria da ABES-RJ, o estudo apresentado mostra um diagnóstico da regulação do setor de saneamento no Brasil e faz um paralelo com a Lei 11. 945, de 2007, que é o marco principal da regulação de saneamento no Brasil. “A Siglasul faz uma abordagem muito interessante sobre essa lei no diagnóstico. Ela coloca claramente as vantagens e desvantagens dos modelos de regulação, agentes estaduais, municipais e intermunicipais que têm em vários estados no Brasil. Já faz nesse primeiro documento uma avaliação qualitativa desses modelos”.
Assim como a ABES, a ABAR possui diversas câmaras técnicas. A CT Saneamento tem representantes de quase todas as agências do setor no país e aborda em suas reuniões temas como água, esgoto e resíduos. Além disso, as discussões passam também pelas questões econômica, da crise hídrica e dos resíduos sólidos, entre outros.
É o que explica Moitrel Pequeno. “Discutimos a regulação do saneamento sob o viés desses subtemas. Tem uma questão forte que é a jurídica, além das tarifas, penalidades, contabilidade regulatória”, diz. “Gostamos também de nos inserir em tudo que está acontecendo no Brasil e no mundo sobre a questão do saneamento”. Segundo o engenheiro, há uma interface forte entre o saneamento da ABES e a ABAR. “Basicamente todo mundo que milita no saneamento das agências reguladoras também milita na ABES”.
