Simpósio Regulação e Tarifas: leia a entrevista com o especialista português Joaquim Poças, um dos convidados do encontro

O objetivo do encontro é avaliar e debater as regras, orientações e medidas de controle introduzidas pelo novo marco regulatório. Faça aqui sua inscrição gratuita.

Nesta entrevista ao Portal ABES Notícias, Joaquim Martins Poças, consultor especializado em Regulação do Setor de Saneamento na Europa, fala sobre a importância da realização do evento e esboça o cenário da regulação ao redor do mundo. Poças, que é Professor da Faculdade de Engenharia da Universidade do Porto e Secretário-Geral do Conselho Nacional da Água de Portugal, destaca, ainda, como uma grande iniciativa da ABES e do Brasil, o Prêmio Nacional de Qualidade em Saneamento – PNQS, a maior premiação do setor no país.

ABES Notícias – Qual é o panorama da regulação dos serviços de saneamento em Portugal e demais países europeus? Quais casos poderiam servir de exemplo para aplicação no Brasil?

Joaquim Poças – Surpreendentemente, a maioria dos países da Europa e do mundo ainda não tem regulação do setor do saneamento, mas a tendência é a de passarem a ter. Não tenho dúvida que o consumidor e o meio ambiente se beneficiam da existência de uma entidade independente do setor político a regular um setor monopolista que presta serviços públicos essenciais; o regulador tem de ter grande capacidade de análise técnica, económica e jurídica. Em alguns casos, há algumas interferências do setor político na regulação, mas também há exemplos de reguladores que indevidamente interferem em domínios que são de natureza política. Por exemplo, não compete ao regulador reestruturar e reorganizar o setor do saneamento, decidir entre competências municipais e estaduais, optar entre gestão pública e privada e decidir quanto devem pagar os diferentes tipos de usuários num determinado sistema. O OFWAT Inglês, com mais de trinta anos, é, talvez, o regulador mais antigo, e tem grande independência relativamente ao setor político e muito poder na definição das tarifas, porque as entidades gestoras na Inglaterra são totalmente privadas e são proprietárias das infraestruturas, o que não acontece nem em Portugal nem no Brasil. O caso Português é muito interessante e também já está bastante maduro. Participei, enquanto Secretário de Estado do Ambiente de Portugal, na criação da primeira entidade reguladora nacional e depois, enquanto diretor presidente das maiores empresas de água de Portugal. Fui regulado e considero que esse facto me ajudou a gerir melhor, a tomar melhores decisões em defesa dos usuários. A definição de indicadores de desempenho da ERSAR, a entidade reguladora de Portugal, o sistema de recolha de dados que utiliza e a sua divulgação pública, através da Internet, são certamente aplicáveis em qualquer país do mundo.

ABES Notícias – Quais, em sua opinião, são os maiores entraves da regulação no Brasil?

Joaquim Poças – O Brasil tem empresas de saneamento que são do melhor que há no mundo. Mas o país, com a dimensão de um continente, tem realidades muito distintas. Regular um pequeno município do interior é muito diferente de regular a SABESP ou a COPASA. A regulação pode ajudar no desenvolvimento do setor, pode, por exemplo, incentivar a agregação de municípios menores, sem possibilidade de dispor de equipes técnicas e de gestão altamente profissionalizadas como hoje é necessário, por exemplo, para ter perdas reduzidas. O simples fato de divulgar publicamente, para um determinado sistema, por exemplo, perdas de água muito elevadas durante anos consecutivos, levará certamente a que os poderes políticos tomem decisões sobre uma reestruturação que ponha termo ao mau desempenho.

ABES Notícia – Falando sobre a relação entre serviços públicos e atividades econômicas, muitas pessoas rejeitam o fato de ter de pagar pelos serviços de abastecimento – seja por meio de tarifa seja por meio de imposto.  Como é esta relação na Europa?

Joaquim Poças – Na Europa, há diretivas comunitárias de aplicação obrigatória que consagram os princípios do utilizador-pagador, do poluidor-pagador e da recuperação integral de custos (full-cost recovery). Os níveis de inadimplência são geralmente muito baixos e em alguns países praticamente nulos.  Em Portugal, há tarifas sociais para famílias de baixa renda e tarifas especiais para famílias numerosas, mas todos pagam mensalmente as suas contas de água. Em nenhum lugar do mundo é fácil assegurar e especialmente cobrar o serviço de água e esgoto em zonas de habitação informal ou clandestina. Em algumas situações acaba por se optar por classificá-los como consumos sociais, pagos pelos restantes usuários que têm nas suas contas uma parcela escondida que corresponde ao consumo dos que não pagam. Quando os consumos clandestinos são 2% ou 3% do total, o problema é um, se são 20% ou 30% o problema é outro. Este não é, na base, um problema de regulação, mas o regulador pode determinar a explicitação dos consumos não autorizados nas contas das entidades gestoras e, consequentemente, o seu impacto nas tarifas, que são mais elevadas porque alguns não pagam. Tenho conhecimento de empresas de água Brasileiras que têm feito um trabalho notável na redução da inadimplência.

inscricoesABES Notícias – O que o senhor espera do evento? De que maneira ele pode contribuir para a questão da regulação do saneamento no Brasil?

Joaquim Poças – A regulação é um processo que evolui e se aperfeiçoa no tempo, como o próprio setor do saneamento. Cada país é um caso, as outras experiências internacionais servem de inspiração, mas o contexto político e social e a dimensão dos sistemas e seu estado de gestão são sempre determinantes. É verdade que aprendemos com os erros e é muito melhor quando aprendemos com os erros dos outros, de quem começou primeiro. Mas infelizmente, tal como nas nossas vidas, em alguns casos só aprendemos mesmo com os nossos próprios erros. Para gerir bem é preciso quantificar e medir. A simples comparação e divulgação de indicadores de desempenho, por exemplo as perdas de água e as tarifas, por uma entidade independente, tem um grande impacto na melhoria do setor. Este evento, que reúne especialistas, gestores, reguladores e políticos, permitirá trocar opiniões e experiências certamente enriquecedoras. Os problemas do setor, em particular a universalidade, a eficiência (perdas de água e de energia), a sustentabilidade econômica e a fixação de tarifas justas só se resolvem com a colaboração de todas as partes interessadas.

Joaquim Poças – Compartilhar as experiências, os sucessos e os insucessos num curso de regulação, sob a égide de entidades tão reputadas, é uma forma extremamente poderosa e eficaz de fazer crescer as entidades gestoras. Mas quero terminar referindo uma realidade relacionada com este tema e em que o Brasil e a ABES podem se orgulhar de ser pioneiros a nível mundial: o PNQS, que tem contribuído decisivamente para melhorar a gestão das empresas de água do Brasil, em alguns casos antes de haver regulador. A formação a que obriga a todos os níveis nas empresas participantes, os indicadores de desempenho, as auditorias, os relatórios de sustentabilidade e muito especialmente o empenhamento de todos nos resultados da empresa tem tido certamente uma quota-parte muito significativa nas melhorias do setor nos últimos anos. E, depois, é “viciante” no bom sentido: depois de entrar a primeira vez, cada empresa tem de continuar sempre, para melhorar o seu desempenho relativamente aos anos anteriores e, também, em relação às restantes com que se compara. A diretoria e os trabalhadores se beneficiam, mas os usuários e o meio ambiente é que ganham mais!
