Proposta é um substitutivo do deputado federal João Paulo Papa a PL de autoria do senador José Serra.
A Comissão de Constituição, Justiça e Cidadania – CCJC da Câmara dos Deputados aprovou, nesta quarta-feira, 18, o substitutivo do deputado federal João Paulo Papa (PSDB-SP) ao projeto de lei do senador José Serra, que cria o Regime Especial de Incentivos para o Desenvolvimento do Saneamento Básico – Reisb.
Com a criação deste dispositivo, as empresas prestadoras de serviços públicos de saneamento poderão aumentar o volume de investimentos, por meio da concessão de créditos relativos ao PIS/Cofins e Pasep. A estimativa é de que até R$ 3 bilhões sejam incrementados ao setor, que sofre com a falta de investimento e o atraso em obras.
João Paulo Papa foi o relator do projeto de Serra na Comissão de Desenvolvimento Urbano – CDU. No colegiado, analisou a temática central do projeto e apresentou um novo texto que aprimorou o texto do senador. O texto ainda foi apreciado (e aprovado) pela Comissão de Finanças e Tributação – CFT, onde foi relatado pelo deputado Silvo Torres (PSDB-SP). Na CCJC, o relator foi o deputado Jutahy Júnior (PSDB-BA).
O parlamentar destaca que a aprovação do projeto é uma grande vitória para o Brasil. “Demos um passo fundamental, histórico. Ressalto o papel do senador José Serra, grande defensor da universalização do saneamento. Somos 100 milhões de brasileiros sem coleta de esgoto e 120 milhões sem acesso a esgoto tratado. Este projeto auxiliará a mudar a triste realidade vivida no Brasil”, observa.
Durante a discussão na CCJC, o deputado Padre Luiz Couto (PT-PB) apresentou um voto em separado, que foi derrotado pela maioria dos membros do colegiado.
Mais investimentos
O parlamentar explica que o projeto aprovado pela Câmara não se trata de desoneração pura e simples do setor, nem da transformação dos investimentos em créditos perante os impostos. “Por meio do Reisb, apenas projetos que estejam de acordo com o Plano Nacional de Saneamento Básico – Plansab e que representem um valor adicional ao valor médio anual de investimentos da pessoa jurídica podem pleitear créditos”. Ainda de acordo com ele, é preciso, também, garantir que os investimentos sejam voltados para a sustentabilidade e a eficiência dos sistemas de saneamento básico, assegurando, por exemplo, a incorporação de novas tecnologias aos projeto.
Papa lembra que, de acordo com o ranking internacional do saneamento produzido pelo Instituto Trata Brasil, o País ocupa a 112a posição entre 200 nações analisadas. “Levando em consideração o ritmo de investimentos no setor nos últimos anos, o Brasil somente será capaz de universalizar o saneamento em 2055. Precisamos oferecer soluções para que o objetivo nacional não seja frustrado, e o Reisb é um caminho”, finaliza.
Repercussão
Parlamentares membros da Comissão ressaltaram a importância do projeto para o País. O relator do texto no colegiado, deputado Jutahy Júnior, agradeceu aos colegas de comissão pelo expressivo apoio e por se sensibilizarem com um tema fundamental para o desenvolvimento do Brasil. “Parabenizo, em especial, o deputado João Paulo Papa pelo trabalho desenvolvido na comissão específica de mérito”, disse.
Betinho Gomes (PSDB-PE) ressaltou que o Reisb atenderá aqueles que mais precisam. “O projeto é extremamente importante para as empresas de saneamento investirem em algo essencial, pois estamos muito atrasados nesse tema”. Espiridião Amin (PP-SC) afirmou que o investimento federal nessa área “é muito pouco”. “A destinação desta receita em uma atividade altamente meritória deve ser ressaltado. O senador Serra e o deputado Papa devem ser parabenizados pelo trabalho”.
Max Filho (PSDB-ES) observou que o saneamento é um dos problemas mais graves e urgentes da atualidade e pede medidas para avançar. “Sofremos em todo o País com doenças vinculadas aos problemas gerados pela má utilização da água”. Para o deputado Rocha (PSDB-AC) o projeto terá um grande alcance e será benéfico para milhões de brasileiros. “Aproveito para cumprimentar o relator aqui na Comissão, deputado Jutahy e o deputado Papa pelo belo trabalho”. Paulo Abi-Ackel (PSDB-MG) também reforçou a abrangência e importância do projeto para o Brasil.
Agora o projeto volta ao Senado Federal, para que seja apreciado o novo texto de João Paulo Papa. Na Casa, passará pelas comissões de Assuntos Sociais, Assuntos Econômicos e Constituição e Justiça. Se aprovado, seguirá à sanção presidencial.
