15º Seminário de Resíduos Sólidos: especialistas discutem políticas públicas dos resíduos no Brasil

Painel do primeiro dia contou com palestra internacional, que trouxe o modelo técnico e econômico da gestão de RSU na Espanha, com o professor catedrático da Universidade Jaime I, Antonio Gallardo Izquierdo.

O primeiro painel do 15º Seminário Nacional de Resíduos Sólidos (SNRS) discutiu, nesta quarta-feira, 17 de novembro, Política Pública de Resíduos Sólidos no Brasil”. O evento acontece online, em plataforma interativa, e presencial, no Museu de Minérios do Rio Grande do Norte, em Natal, até esta sexta-feira (18).  O seminário é uma realização da Associação Brasileira de Engenharia Sanitária e Ambiental – ABES, por meio da Seção Rio Grande do Norte (ABES-RN) e da Câmara Temática de Resíduos Sólidos.

O evento conta com patrocínio o CTR Potiguar (Centro de Tratamento de Resíduos) e Prefeitura de Natal, e apoio do Governo do Estado do Rio Grande do Norte, da Fundação de apoio ao IFRN – FUNCERN e do Instituto Federal de Educação, Ciência e Tecnologia do Rio Grande do Norte (IFRN).

Com moderação de Geraldo Antonio Reichert, engenheiro do Departamento Municipal de Limpeza Urbana de Porto Alegre (DMLU), o primeiro painel começou com a palestra “A Lei nº 14.026/2020 e suas implicações na gestão de Resíduos”, ministrada pelo advogado e técnico em Gestão Pública, Marlon do Nascimento Barbosa, mestrando em Direito, Inovação e Regulações. 

Ele apresentou como o Novo Marco Regulatório, Lei nº 14.026/2020, trata a questão da gestão de resíduos sólidos, comparando com as regulações anteriores. “Não houve uma grande novidade quanto à política do saneamento, mas houve um realce de várias políticas públicas dessa área, inclusive focando em alguns aspectos que até então tinham sido deixados de lado por diversos gestores brasileiros, sobretudo nos médios e pequenos municípios que são o grande foco dos problemas brasileiros na área do saneamento”, destacou.  

Segundo o especialista, a nova lei reafirma políticas públicas de gestão na área do saneamento, “sobretudo com a finalidade de alcançar o interesse público, focando muito na saúde pública”. Ele reforçou que especificamente na questão dos resíduos, a lei foca na “destinação final ambientalmente adequada”, expressão que consagra a política pública do resíduo “enquanto ação do saneamento”. 

O palestrante Wladimir Ribeiro, advogado na Manesco, Ramires, Perez, Azevedo Marques – Sociedade de Advogados, abordou o tema “Instrumentos de Sustentabilidade Econômica”. Sua apresentação trouxe a seguinte questão: “Quem deve financiar o serviço público de manejo de resíduos sólidos urbanos?”. 

Ele falou sobre quem deve pagar a conta do manejo de resíduos: “os impostos; o consumidor, o que seria o mais correto, mas o Brasil por razões culturais não consegue implantar a política da logística reversa; ou por meio de taxa ou tarifa”.

De acordo com Wladimir Ribeiro, “a cobrança pela prestação do serviço se tornou um dever dos municípios com a publicação da lei 14.026 de 2020, conhecida como Novo Marco Regulatório do Saneamento. E para contribuir para que os municípios possam cumprir com essa obrigação, a ANA (Agência Nacional de Águas e Saneamento Básico) editou a norma de referência número 1, que detalha como pode haver essa cobrança de taxa ou tarifa, sendo que a preferência é pela tarifa, por ser a que mais se adequa à dinâmica que o manejo dos serviços sólidos e urbanos tem que atender”.  

A terceira palestra foi sobre o papel feito pela Agência Reguladora de Águas, Energia e Saneamento Básico do Distrito Federal (Adasa) no acompanhamento do Plano de Resíduos do Distrito Federal, apresentado por Elen Dânia Santos. “É importante colocar que a entidade reguladora não atua apenas na edição de normas de qualidade ou econômico-financeira, ela também auxilia na estruturação do setor, seja na capacitação dos técnicos, seja no processo de informação, na sistematização”, ressaltou Elen. “É uma atividade regulatória que muitas vezes os municípios não têm essa visão do ente regulador, então é importante pontuar essas diversas nuances que a regulação possui e que foi devidamente definida e estabelecidas nas políticas nacionais, tanto de saneamento básico quanto de resíduos sólidos”.

Na palestra “Acompanhamento da implementação do Plano Distrital de Gestão Integrada de Resíduos Sólidos (PDGIRS)”, foi apresentada a avaliação anual realizada pela Adasa, entidade reguladora, que representou um dos principais meios de verificação da efetividade da implementação do planejamento proposto pelo titular dos serviços.

A avaliação trouxe como aprendizados “o melhor entendimento dos processos de geração de informações do prestador de serviços; e o próprio prestador de serviços acaba tendo o conhecimento de forma mais sistematizada, de uma maneira institucional”. A avaliação também gera informações tempestivas, com confiabilidade para tomada de decisão gerencial.

“O monitoramento anual pela Adasa constitui uma das principais fontes de informação para subsidiar as revisões do próprio plano. Com a experiência de avaliação, a Adasa observou a necessidade de elaborar um manual de auditoria e certificação das informações declaradas para o cálculo dos indicadores estabelecidos no ‘PDGIRS: Projeto ACERTAR Resíduos Sólidos’; projeto piloto, previsto para ser concluído até julho de 2023, objetivando o aperfeiçoamento e maior confiabilidade das informações”. 

A última palestra do painel foi internacional, trazendo o modelo técnico e econômico da Gestão de Resíduos Sólidos Urbanos na Espanha, com Antonio Gallardo Izquierdo, professor catedrático da Universidade Jaime I, de Castellón de La Plana, na Espanha.

O professor espanhol começou contextualizando as últimas legislações da Espanha e Europa sobre o assunto. Ele apresentou o modelo técnico de gestão dos resíduos sólidos urbanos, os modelos implantados para a coleta e separação dos resíduos sólidos, os tratamentos de resíduos feitos e o modelo econômico da gestão de resíduos, que se baseia no “princípio de corresponsabilidade, quem contamina paga, em uma responsabilidade ampliada do produtor pelos seus resíduos”. 

Segundo ele, surgiu na década de 70 uma série de programas e ações na comunidade europeia para a melhoria do meio ambiente. E na década de 80, surgiu o conceito dos 3 Rs – reduzir, reutilizar e reciclar e o conceito de que o poluidor deve pagar pelos custos do que polui, nascendo o conceito de corresponsabilidade. “Isso parece óbvio hoje, mas não existia isso de que o poluidor paga”, lembrou, “e é claro e razoável que o poluidor é quem tem que arcar com os custos de tudo de toda essa tecnologia”.  

“O conceito de responsabilidade estendida do produtor foi implementado, isso significa que é o produtor que lança as mercadorias, os produtos e as embalagens para o mercado, e é ele quem tem que cuidar disso e de sua gestão”, resumiu afirmando que várias legislações foram desenvolvidas para isso. 

Cases de Sucesso

Ao término das palestras e debate entre os convidados, o painel apresentou dois casos de sucesso, com coordenação de Sérgio Bezerra Pinheiro, membro da ABES-RN. O primeiro caso foi a Cobrança na Gestão de Resíduos feita pela Agência Reguladora Intermunicipal de Saneamento do Rio Grande do Sul (AGESAN-RS), apresentado pelo diretor geral da AGESAN-RS, Demétrius Jung Gonzalez.

“A agência criou um manual de fiscalização, que está disponível na internet, criou o PPR, que é o Preço Público da Regulação, que é o percentual que nós recebemos por fiscalizar os serviços e regular”, disse Gonzalez, que apresentou a AGESAN-RS, consórcio intermunicipal que regula 40 municípios em saneamento. 

Para finalizar o painel, o segundo caso de sucesso abordou a regulação em resíduos sólidos da Agência Nacional de Águas e Saneamento Básico (ANA), apresentado por Sérgio Luís da Silva Cotrim, coordenador de Resíduos Sólidos da ANA. Cotrim falou sobre “como serão as entidades reguladoras do futuro que irão regular os resíduos sólidos”, com base no Marco Regulatório. “As agências têm que ter independência, autonomia para que possam ser a entidade moderadora que vai conduzir algum conflito de interesses, precisar fazer alguma medição, precisa ter independência e não ser capturada nem pelo poder público nem pelo poder privado”, sublinhou.
