A ABES Seção Pernambuco participou, no dia 23 de setembro, no Plenário da Assembleia Legislativa do Estado de Pernambuco (ALEPE), da Audiência Pública da Comissão Especial para Atualização do Marco do Saneamento Básico – Seminário Recife/PE sobre o PL 3261/2019. O encontro discutiu a atualização do marco legal do saneamento básico e alteração da Lei nº 11.445, de 05 de janeiro de 2007 (Lei do Saneamento Básico), com palestras, pronunciamentos e debate sobre a PL 3261/2019. A coordenação do seminário foi dos deputados federais Carlos Veras, Túlio Gadelha e Sílvio Costa Filho.
O presidente da ABES-PE, Sérgio Santos, integrou a mesa que teve também o deputado federal Carlos Veras, deputado estadual Doriel Barros (representante da ALEPE), José Gomes Barbosa Filho (Pres. do Sindicato dos Trabalhadores nas Indústrias Urbanas no Estado de Pernambuco) e Raimundo Lucena (Diretor do Sinergia e Presidente da Federação Regional dos Urbanitários do Nordeste – FRUNE).
Os palestrantes foram: Manuela Coutinho (Presidente da COMPESA), Ubiratan Pereira (Secretário Executivo da Associação Brasileira das Empresas Estaduais de Saneamento – AESBE), Edson Aparecido da Silva (Mestre em Planejamento e Gestão do território e especialista em meio ambiente e sociedade) e Simone Souza (Vice-Presidente da ABES-PE).
Em seu pronunciamento, Sérgio Santos destacou a necessidade de acabar com a polarização entre público e privado, mas buscar a união de todos, porém com o controle do setor público, para chegar à universalização do saneamento. Falou sobre o Ranking ABES da Universalização do Saneamento: nos 85 municípios mais próximos da universalização, temos 70% estatais, 20% municipais e 10% privados. Nas 10 capitais mais próximas da universalização, também temos representantes dos três setores. Observou ainda sobre as peculiaridades da regionalização: “No Nordeste temos muitos municípios pobres e com sérios problemas de seca. No estado de Pernambuco pouco mais de 10 municípios são superavitários, a maioria na Região Metropolitana do Recife”.
O presidente da ABES-PE lembrou a escassez de água no sertão e principalmente no agreste. “Várias obras de adutoras foram construídas pela COMPESA, transpondo bacias, interligando sistemas, para atender a população. Como agrupar municípios para privatizar de forma sustentável? Não se pode desestruturar todo o setor irresponsavelmente”, alertou, firmando a importância da manutenção do contrato programa, como uma opção fundamental para o titular do serviço.
Sérgio Santos também chamou atenção para a proposta da ABES, que no seu 30º Congresso Nacional, em 19 de junho, em Natal/RN reuniu as entidades representativas do saneamento para assinar o documento “PACTO PELO SANEAMENTO NO BRASIL”, que estabelece:
– Fortalecimento da Regulação pela ANA;
– Definição da Titularidade conforme orientação STF: Municípios Titulares e nas Regiões Metropolitanas Titularidade Compartilhada;
– Equidade entre as Cláusulas do Contratos Programa e Contratos de Concessão, estimulando a EFICIÊNCIA (com Metas e Indicadores de Desempenho para a Universalização).
– Aumentar Participação do Privado: PPP’s, SPE (Sociedades de Propósito Específico), Participação no Capital Social das Empresas de Economia Mista, Subdelegação, Etc.;
– Estabelecimento de Tarifa Justa aos usuários, garantindo o acesso aos serviços com equilíbrio financeiro.
Em sua palestra, Simone Souza, Vice-Presidente da ABES-PE, comentou que a ABES é uma associação não governamental, fundada em 1966, com 10.000 membros individuais e corporativos, atuando nos setores técnico-científico, político-institucional e de gestão. Mencionou os quatro componentes do saneamento básico e esclareceu que o que se aplica na Telefonia e Energia não se vislumbra no caso de água, esgoto e drenagem, que são função do Estado. Comentou as grandes desigualdades territoriais, ambientais e sociais e ressaltou que a atuação do Estado deve ir além do aspecto regulatório. Comentou os subsídios e os Aspectos Regionais e finalizou com uma abordagem ambiental.
