O presidente nacional da ABES, Roberval Tavares de Souza, participou nesta quinta-feira de audiência pública promovida pela OAB-SP para debater a Medida Provisória 844, que atualiza o Marco Legal do Saneamento Básico.

O encontro reuniu diversos especialistas do Direito e do Saneamento: Carlos Ari Sundfeld, Rubens Naves, Rógério Tavares, vice-presidente de Relações Institucionais da AEGEA, Marussia Whately, Helio Luiz Castro, diretor presidente da ARSESP, Luciana Gonzalez, Luis Eduardo Regules e Thais Reis, representando a AESBE.
Em sua apresentação, Roberval apresentou o posicionamento da ABES contrário à MP (veja aqui) e questionou quatro pontos principais: relevância urgente da MP, Artigo 8-B, que diz respeito à alienação do controle acionário, a definição da ANA – Agência Nacional de Aguas, como agência reguladora, e o Artigo 10-A, que trata do chamamento público.
Roberval apresentou ainda o estudo inédito “Abastecimento de água, coleta e tratamento de esgoto – o ganho de escala e a eficiência – Amazonas e Roraima”(veja o estudo aqui).
O levantamento compara dois modelos de operação do saneamento nos estados, o primeiro com a operação fragmentada e o segundo com operação regionalizada. Para isso, foram selecionados indicadores que pudessem demonstrar: – a situação fiscal dos municípios e, portanto, sua capacidade de investimento. – o percentual de atendimento dos serviços de abastecimento de água, coleta e tratamento de esgoto; – e os impactos dos serviços de saneamento na saúde dos munícipes.
