A ABES promoveu, nesta segunda-feira, 19 de março, durante o 8° Fórum Mundial da Água, um debate sobre a proposta do Governo Federal de medida provisória para revisão do Marco Legal do Saneamento.
No encontro, que ocorreu no Espaço São Paulo, na Vila Cidadã do Fórum, a ABES reafirmou seu posicionamento contra a MP (veja o posicionamento da entidade aqui) ao público presente, composto por presidentes de seções estaduais da ABES, autoridades, associados em geral e público do Fórum.
Desde outubro de 2017 a ABES vem trabalhando em algumas propostas. No dia 7 de novembro a entidade entregou um documento ao Governo Federal. “Fizemos um texto sugerindo melhorias e alterações baseadas na minuta de Lei do governo e não recebemos nenhuma resposta. Há pouco mais de vinte dias, fizemos um evento em São Paulo, com a presença da assessora da Casa Civil, Marta Seillier, no qual foram expostos vários pontos que precisavam melhorar no texto. A ABES questiona no documento a tratativa de uma mudança no Marco Legal do Saneamento por meio de medida provisória. Repudiamos essa situação de encaminhar uma mudança tão profunda da lei por medida provisória e sugerimos ao Governo Federal que encaminhasse por meio de projeto de lei”, ressaltou o presidente nacional da ABES, Roberval Tavares de Souza.
Dante Ragazzi Pauli, coordenador da Câmara Temática da ABES de Comunicação no Saneamento, ressaltou a relevância do debate, que impacta o saneamento e seu futuro em nosso país. “Temos que ficar de olhos abertos porque o governo trabalha muito com medida provisória, não abre debate e depois quer discutir no Congresso. A lei precisa ser revisada, fez 10 anos, é um marco regulatório do setor, mas boa parte dos municípios não conseguiram fazer seus planos municipais. Muitas vezes esquecemos que o plano municipal exige a política de saneamento adotada pelo prefeito. Os prefeitos podem escolher como vão fazer a gestão de saneamento e a sua autarquia. Eles não conseguem fazer, não sabem como elaborar o plano e atender as suas exigências. O saneamento não é priorizado no Brasil. O setor público deixa muito a desejar, há empresas estaduais boas, competentes, mas há ruins também.”
“Parabenizo pela articulação da ABES para se manifestar na questão. Uma questão dessa não deve ser tratada com medida provisória”, disse Alceu Guérios Bittencourt, conselheiro da ABES-SP. “A discussão do Marco Legal é importante e mesmo sobre a qualidade na minuta, a forma está mal colocada. Sobre o Artigo 10A, não devemos ser a favor do subsídio cruzado como ele está e seu conceito, que tem uma série de problemas e injustiças sociais. A política de subsídio deve ser mais pensada nas condições de hoje, que reestruture a estratégia de recuperação de custos. Teria que ter recursos fiscais para complementar. A crise fiscal é muito grande. Corre-se o risco de perder o que funciona em nome de aumentar a concorrência e a competividade. Ao fazer isso pode-se perder toda uma infraestrutura que funciona. A estrutura das empresas estaduais/municipais é exemplar para vários países do mundo em desenvolvimento. Muitas coisas são realizadas com arrecadação tarifária. Temos um padrão razoavelmente bom em várias partes do país e que atende a população. Não podemos colocar em risco a estabilidade que temos. Não se pode jogar uma regra pela metade e o processo desencadear sem controle ou planejamento”, frisou Alceu.
Na abertura do Fórum Mundial da Água nesta segunda-feira, o presidente Michel Temer afirmou que o governo está finalizando um Projeto de Lei para mudar o Marco Legal do Saneamento (leia aqui).
