BWW: O Brasil precisa de harmonização regulatória e de melhoria da governança, analisa o presidente do Conselho de Administração do LIS-Water (Portugal), Jaime Baptista

Especialista participará das discussões sobre “O papel das Agências Reguladoras para atingir o Objetivo do Desenvolvimento Sustentável (ODS 6)”, da Brazil Water Week, que começa nesta segunda (23), online, em plataforma digital exclusiva e interativa.

“O Brasil tem um grande número de agências reguladoras, acima de oitenta, e muitas delas são jovens e ainda incipientes. Há, pois, uma grande diversidade de situações, necessitando de um esforço de harmonização regulatória e de melhoria da governança”, analisa o presidente do Conselho de Administração do Lis-Water (Portugal), Jaime Baptista. 

Ele é um dos especialistas das várias partes do mundo que participarão da Brazil Water Week (BWW 2022) – Semana da Água do Brasil, que será realizada de 23 a 27 de maio, plataforma digital exclusiva e interativa. Promovida pela Associação Brasileira de Engenharia Sanitária e Ambiental (ABES), esta será a terceira edição do encontro, que visa promover discussões internacionais sobre questões relativas ao uso da água e ao saneamento básico. Serão 110 participantes compartilhando suas experiências durante 5 dias de programação, que ficarão disponíveis por 90 dias na plataforma do evento.

Baptista participará da sessão que tem por objetivo apresentar e debater os principais desafios e responsabilidades das Agências Reguladoras para a universalização dos serviços de abastecimento de água potável e esgotamento sanitário, no sentido de atender os Objetivos do Desenvolvimento Sustentável – ODS 6. Serão apresentadas experiências nacionais e internacionais sobre a atuação das agências, incluindo aspectos de sua governança. 

Em conversa com o Portal ABES Notícias, Jaime Baptista destaca o papel das agências reguladoras na aceleração e promoção do equilíbrio entre a política pública estabelecida pelo Governo e a sua efetiva implementação pelos operadores. Confira entrevista completa:

Portal ABES Notícias – Do seu ponto de vista qual é o papel das agências reguladoras no sentido de atender os Objetivos do Desenvolvimento Sustentável – ODS 6? 

Jaime Baptista – O objetivo de água e saneamento das Nações Unidas só pode ser alcançado com boas políticas públicas, essenciais para a obtenção de adequados serviços às populações. Essas políticas são programas de ação governamental que visam coordenar os meios disponíveis para alcançar objetivos coletivos socialmente relevantes. Fazem recurso a vários componentes e incentivos, sendo que as agências reguladoras são um desses componentes e realizam a sua atividade no âmbito da lei e da política pública estabelecida pelo Governo. As agências reguladoras são o acelerador e o equilíbrio entre a política pública estabelecida pelo Governo e a sua efetiva implementação no terreno pelos operadores.

Portal ABES Notícias – Como a governança nas agências reguladoras contribui para atingir essas metas?

Jaime Baptista – Há a necessidade de consolidar nas agências reguladoras uma governança interna de grande eficácia e eficiência, face a objetivos, missão, mandato, poderes e âmbito de intervenção. Para isso,  as agências reguladoras devem ter recursos humanos de elevada competência, fortemente motivados e grande espírito de equipe, sob uma forte, clara e reconhecida liderança.

Têm que reforçar a sua eficácia através de uma boa regulação legal e contratual, econômica, de qualidade de serviço, de qualidade da água potável e de interface com os utilizadores. Devem ter uma ativa contribuição para a boa organização do setor, para a adequada legislação, para a necessária informação e para a capacitação dos profissionais.

Portal ABES Notícias – Quais os principais desafios das agências reguladoras para atingir a universalização dos serviços de abastecimento de água potável e esgotamento sanitário?

Jaime Baptista – As agências reguladoras devem contribuir para a eficácia dos serviços, promovendo a acessibilidade física, a continuidade e fiabilidade, a qualidade das águas para abastecimento e rejeitadas, a segurança, a resiliência e a equidade e acessibilidade econômica. Devem também contribuir para a eficiência dos serviços, promovendo a governança e a estruturação do setor, a organização, modernização e digitalização das entidades gestoras, a gestão e alocação de recursos financeiros, a eficiência hídrica e a eficiência energética e descarbonização. Devem, finalmente, contribuir para a sustentabilidade dos serviços, promovendo a sustentabilidade econômica e financeira, a sustentabilidade infraestrutural, a utilização e recuperação de recursos, o capital humano e a gestão de informação, conhecimento e inovação.

Portal ABES Notícias – Quais são os maiores desafios para o processo de transição entre modelos regulatórios em andamento no Brasil?

Jaime Baptista – O Brasil tem um grande número de agências reguladoras, acima de oitenta, e muitas delas são jovens e ainda incipientes. Há, pois, uma grande diversidade de situações, necessitando de um esforço de harmonização regulatória e de melhoria da governança. Os reguladores devem estar preparados para apoiar a promoção de economias de escala com a prevista regionalização da prestação dos serviços. Devem estar capacitados para lidar com contratos novos ou vigentes. Devem ser capazes de contribuir para maior atratibilidade de investimentos para o setor, reduzindo insegurança jurídica e tornando mais facilmente alcançável a universalização.
